3.1 The provision of data requested during the activation of Services for the purposes outlined in section 2.2A is obligatory. This is necessary for the effective provision of requested Services and for fulfilling legal obligations. Refusal to provide this data will result in the inability of BOOZ to proceed with providing the requested Services and/or fulfilling legal obligations..

Users have the option to object to the processing of their data for the purposes outlined in sections 2.2B and 2.2C. They can do so immediately by withholding their consent during the activation of the newsletter Service or other Services. Alternatively, they can object at a later time by sending an email to info@boozitaly.com.

During the activation of Services, users are presented with checkboxes to consent to the use of their data for the specified purposes. If users do not select a particular checkbox, it will be interpreted as them not consenting to the processing of their data for that purpose.

4. Processing methods

4.1 Users’ data will be collected online during the activation of requested Services, either by comparing pieces of information or through the use of email services.

Personal data stored in paper form will be maintained in specific registers and/or records, with their preservation ensured by placing them in designated containers stored in appropriate premises.

BOOZ affirms that data registered on its server and/or in designated premises are safeguarded against intrusion and unauthorized access. Adequate security measures have been implemented to ensure data integrity and availability, as well as to protect areas and locations for data storage and accessibility. Additionally, the company hosting BOOZ’s server is duly certified according to the Privacy Shield framework.

4.4 Personal data will be processed by BOOZ’s employees and/or collaborators acting as data processors or individuals responsible for processing, within the scope of their respective roles and in compliance with instructions provided by BOOZ.

5. Data disclosure

Users’ personal data may be disclosed to specific parties appointed by BOOZ FZC to provide the requested Services and fulfil legal obligations. Such disclosure may include sharing data with:

a) Individuals, companies, or professionals providing BOOZ with bookkeeping, administrative, legal, fiscal, financial assistance, consulting services, or collaboration.

b) Entities delegated or appointed by BOOZ to carry out activities or parts thereof related to the provision of requested Services, as well as other external parties collaborating with BOOZ who require access to data to properly fulfill contractual obligations for the provision of Services.

Users’ data will not be disseminated beyond these specified parties.

6. Users’ rights

Users (hereafter referred to as “data subjects”) have the right to obtain confirmation of the existence of their personal data and the purposes for which the data are processed at any time. c) If the processing is based on the user’s consent, the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

d) The right to lodge a complaint with a supervisory authority (data protection Authority).

e) Whether the provision of personal data is a legal or contractual requirement, or a requirement necessary to enter into a contract, and whether the data subject is obliged to provide the personal data, along with the possible consequences of failure to provide such data.

f) The existence of automated decision-making, including profiling, and where such automated decision-making process has legal effects or similarly significant effects on the data subject, relevant information about the logic involved, as well as the significance and consequences of such processing for the data subject.6.2.4 The data subject shall have the right to object, at any time, to processing of personal data concerning him or her:

a) on grounds relating to his or her particular situation, including profiling;

b) where personal data are processed for direct marketing purposes, which includes profiling to the extent that it is related to such direct marketing.

6.2.5 Data Subject Rights

The data subject shall have the right to:

a) Promptly receive from the controller the rectification of inaccurate personal data concerning them. Considering the purposes of the processing, the data subject shall also have the right to have incomplete personal data completed, including by providing a supplementary statement.

b) Receive the personal data concerning them, which they have provided to BOOZ, in a commonly used electronic format and in an easily readable manner. They also have the right to transmit this data to another controller without hindrance.

c) Promptly obtain from the controller the deletion of personal data concerning them, and the controller shall have the obligation to erase personal data without undue delay where one of the following grounds applies:

The personal data are no longer necessary for the purposes for which they were collected or otherwise processed.

The data subject withdraws consent on which the processing is based, and there is no other legal ground for the processing.

The data subject objects to the processing, and there are no overriding legitimate grounds for the processing.

The personal data have been unlawfully processed.

The personal data must be erased to comply with a legal obligation under European Union law or Member State law to which the controller is subject.

d) Obtain from the controller restriction of processing.6.3To exercise the above mentioned rights and receive information on parties to whom the data are disclosed, or parties who may become aware of data while acting as data processors or persons in charge of the processing, the users may contact Booz by sending a request using the contact details provided above.

The controller shall provide the information related to the action taken on a data subject’s request without undue delay and no later than one month after having received the request. That period may be extended by two further months where necessary, taking into account the complexity and number of the requests. The controller shall inform the data subject of any extension within one month after having received the request, together with the reasons for the delay. Where the data subject makes the request by electronic form means, the information shall be provided by electronic means where possible, unless otherwise requested by the data subject.

7. Duration of Processing

7.1 Personal data will be processed for the purpose mentioned in section 2.2.A for no longer than necessary for the performance of the required Services and for fulfilling current civil, fiscal, and tax obligations. In any case, data will be retained for no longer than 10 years from the termination of the underlying obligation, as per applicable statute of limitation provisions.

7.2 Personal data for marketing/promotional activities mentioned in section 2.2.B will be processed for a maximum of 24 months from the date consent to the processing of personal data was given.

7.3 Personal data for profiling activities mentioned in section 2.2.C will be processed for a maximum of 12 months from the date consent to the processing of personal data was given.

7.4 At the end of the data processing period, the data will be deleted or permanently rendered anonymous.

8. Legal Basis for Processing

8.1 The legal basis for processing shall be constituted in accordance with the user’s consent, compliance with contractual requirements, and legal provisions.

9. Updating of Privacy Policy
